1.0 ABOUT

1.1 Welcome to www.raeshields.com (the Website), operated by Rae Shields (we, us, our).

1.2 Access to and use of the Website, or any of its associated products and/or services, are provided by Rae Shields. Please read these terms and conditions (the Terms) carefully.

2.0 Acceptance of these Terms

2.1 These Terms apply to the use of our Website and our products and services. By using, Browse, registering an account, and paying for the products and/or services on the Website, you agree to be bound by these Terms as well as any and all general terms and conditions posted on our Website from time to time. If you do not accept these Terms, you must cease use of the Website and our products and services immediately.

2.2 You may not accept the Terms if:

(a) you are not of legal age to form a binding contract with Rae Shields; or

(b) you are a person barred from receiving the products and services under the laws of United States or other countries including the country in which you reside or from which you use the Website, products, or services.

2.3 Rae Shields reserves the right to review and change any of the Terms by updating this page at its sole discretion. When we update the Terms, we will use reasonable endeavors to provide you with notice. Any changes to the Terms take immediate effect from the date of publication.

3.0 Products

3.1 Rae Shields provides its customers with customized jewelry (the Products).¹

3.2 When you place an order with us, you select the style and customization of the Product, including but not limited to, any initials, fingerprints, handprints, footprints, portraits, and/or handwriting to be engraved onto the Product(s) (the Customization).²

3³.3 The Customization is based on your preferences and is dependent on the accuracy of the details that you provide us upon placing an order. You agree and acknowledge that we will not be liable for typographical errors or changes in your aesthetic preferences after an order is placed.

3.4 The rendering service available on the Website is for inspirational purposes only. You agree and acknowledge that the size, placement, and overall look of the Products may vary slightly from the image displayed.

3.5 We may request you to re-scan and send any photo of prints if the images are unclear. We reserve the right to charge additional fees if we require further prints from you.

3.6 Care instructions for the Product(s) will be included to maximize their longevity. We will not be liable for any damage caused by your misuse of the Products.

3.7 By using the Products, you acknowledge that:

(a) you are solely responsible for assessing any risks, including skin allergies or reactions.

(b) we do not provide any warranties or guarantees regarding the Products.

(c) you must use the Products for personal use only and not for resale.

(d) we reserve the right to terminate your access to the Products and the Website at our sole discretion.

4.0 Customizing Your Piece with Prints

4.1 To personalize your jewelry, we'll need photos or prints of hands, feet, or portraits (referred to as "Prints"). You can send these to us electronically or by mail.

4.2 If you send your Prints electronically, please know that we might use third-party apps for processing. By doing so, you agree to their terms and privacy policies.

4.3 If you prefer to mail your Prints, we'll send you a special kit. Here's what you should know:

1. The cost of this kit is included in your product fee, but delivery charges may apply.
2. Please double-check your delivery address. If it's incorrect and we need to resend the kit, additional re-delivery fees may apply.
3. Once we receive your Prints, our production team will select the best one for engraving at their discretion.
4. If your Prints aren't suitable for customization, we'll let you know. An additional fee will apply for a new kit in this case.

4.4  Production turnaround is at least six weeks from the date we accept your Prints. This timeframe might be longer during peak seasons.

4.5  Please understand that we are not responsible for delays caused by rejected Prints.

4.6  Due to the unique shapes and sizes of our products, the engraved Prints may not be true to size on your final piece.

5.0 Account Establishment

5.1 To access the Products, you may be required to register an account on the Website (the Account).

5.2 To establish an Account, you may be required to provide personal information such as your name, email, mailing address, and phone number.

5.3 You agree that any information you provide will always be accurate, correct, and up to date.

5.4 We reserve the right to terminate your Account if you provide misleading, false, or outdated personal information.

6.0 Your Account Obligations

6.1 You agree that:

(a) you are solely responsible for the activity that occurs under your Account.

(b) you have the sole responsibility to protect the confidentiality of your password. You must notify us immediately at info@raeshields.com of any unauthorized use.

(c) you will use the Website and Products as permitted by these Terms and any applicable laws.

(d) you must not use the Products or Website for any illegal or unauthorized purpose.

(e) you must not interfere with or hack our servers or networks.

7.0 Acceptance of Order

7.1 All Product orders will be accepted at our sole discretion (the Order).

7.2 When you submit an Order and we accept it, you will receive a confirmation email. If we do not accept your Order, we will notify you. Reasons for rejection may include your delivery location or Product availability.

7.3 If we reject your Order, we will promptly refund the full amount paid.

 

8.0 Delivery

8.1 You will be charged a delivery rate based on your location (the Delivery Fee). All redeliveries or returns will be at your own cost.

8.2 If you are not at the delivery location at the intended time, the Products may be left at the front door. We are not liable for any damage or theft that occurred after delivery.

8.3 You are responsible for ensuring your mailing details are correct. We may charge an additional Delivery Fee for re-delivery due to an incorrect address.

8.4 The title and risk of loss or damage to the Products pass to you upon delivery.

8.5 We may use a third-party provider for delivery services. By accepting these Terms, you consent to your personal information being shared with them for delivery purposes.

 

9.0 Prices

9.1 All prices are in dollars and exclude Sales Tax

9.2 Prices quoted on the Website are subject to change without notice.

9.3 If the price of a Product is reduced after you have placed an Order, you are not eligible for a price adjustment.

10.0 Payment

10.1 We may use third-party payment gateways (the Payment Gateway Provider). You agree to be bound by the applicable terms and conditions and privacy policy of the Payment Gateway Provider.

10.2 If a payment request is denied by your financial institution or remains unpaid, you are liable for any associated costs, including banking fees.

11.0 Refunds

11.1 If you are unsatisfied with the Products, please contact us at info@raeshields.com  to explain why you believe you are entitled to a refund.

11.2 Due to the personalized nature of the Products, refunds will not be issued once the Products have been delivered.

11.3 Any refunds granted will be at our sole discretion.

12.0 Discounts and Promotions

12.1 Any discounts or promotion codes are non-transferable and cannot be exchanged for cash.

12.2 Discounts cannot be combined with other offers.

12.3 We reserve the right to cancel any discount or promotion without prior notice.

13.0 Intellectual Property

13.1 The Website and the Products of Rae Shields are subject to copyright. All rights are reserved.

13.2 All custom graphics, icons, logos, and service names are trademarks or service marks belonging to us. These Terms do not transfer any of our intellectual property rights to you.

13.3 Any unauthorized use of materials appearing on our Website may violate copyright, trademark, and other applicable laws and could result in penalties.

14.0 Privacy

14.1 Rae Shields is committed to protecting your privacy. We adhere to the privacy principles established in Privacy Act 1974 . Please read our Privacy Policy at Privacy Policy

14.2 By using the Website, creating an Account, or accessing the Products, you consent to the collection, use, and storage of your personal information as outlined in our Privacy Policy.

15.0 Liability

15.1 To the maximum extent permitted by law, our liability arising out of or in connection with the Products or these Terms is limited to the fees paid by you for the Products.

15.2 You agree that Rae Shields will not be liable for any direct, indirect, incidental, special, or consequential damages which may be incurred by you.

16.0 Indemnity

16.1 You agree to indemnify Rae Shields and its affiliates from and against all actions, claims, liabilities, costs, and expenses arising out of or in connection with any breach of these Terms or any unlawful or negligent act by you.

17.0 Dispute Resolution

17.1 If a dispute arises, a party must give written notice to the other party detailing the nature of the dispute.

17.2 On receipt of the notice, the parties must endeavor in good faith to resolve the dispute through negotiation within thirty (30) days.

17.3 If the dispute is not resolved, the parties must agree upon a mediator or request one be appointed by an appropriate dispute resolution center. The mediation will be held in North Carolina, United States.

18.0 Governing Law and Jurisdiction

18.1 The Terms are governed by the laws of North Carolina, United States. Each party irrevocably and unconditionally submits to the jurisdiction of the courts of  North Carolina, United States.

19.0 Notice

19.1 We may provide any notice to you under the Terms by sending a message to your email address.

19.2 Unless specified otherwise, any notices from you to us must be in writing and delivered in person or via registered post to info@raeshields.com; 14 Granville Dr, Pinehurst, NC 28374, US.

20.0 Severance

20.1 If any part of the Terms is found to be void or unenforceable, that part will be severed, and the rest of the Terms will remain in force.

21.0 Waiver

21.1 A waiver of any right, power, or remedy under these Terms must be in writing signed by the party granting it.

21.2 A waiver is only effective in relation to the particular obligation or breach in respect of which it is given. It is not to be taken as an implied waiver of any other obligation or breach or as an implied waiver of that obligation or breach in relation to any other occasion.

21.3 The fact that a party fails to do, or delays in doing, something the party is entitled to do under these Terms does not amount to a waiver.

22.0 Assignment

22.1 Rae Shields may assign or transfer its rights or obligations under the Terms without your consent.

22.2 You may not assign or transfer your rights or obligations under the Terms without the prior written consent of Rae Shields. A purported assignment without written consent will be deemed to be void and convey no rights.

23.0 Links

23.1 Our Website and correspondence to you may contain links to other websites. These links are intended for your convenience only. Please be aware that Rae Shields is not responsible for the privacy practices of such other websites. We encourage our users to be aware, when they leave our Website, to read the privacy statements of each and every website that collects personally identifiable information. This privacy statement applies solely to information collected by this Website.

24.1 Rae Shields may also provide you with information and updates regarding our Website and changes to the law from time to time. Rae Shields may also make you aware of new and additional Products via email. This service is free and you can unsubscribe at any time.

25.1 We reserve the right to modify our policies at any time, including these Terms and our Privacy Policy, in our sole discretion. All modifications will be effective immediately upon our posting of the modifications on this Website.
